New Mexico’s secretary of state is suing Otero County’s Republican-led commission after it refused to certify June’s primary election results, citing conspiracy theories about voting machines.

The three-person commission in Otero County, in southern New Mexico, on Monday voted against certifying the results of the June 7 primary election for races including governor, congress and attorney general despite the county clerk’s assurances that the vote was sound.

…first, conspiracy to defraud the United States; and, second, conspiracy to obstruct an official proceeding. The first one is more broad. The second one is more specific.

What does that mean, “conspiracy to defraud the United States”?

The statutory citation is Title 18 of the United States Code, Section 371. It is sometimes referred to as the Klein Conspiracy, after a case named United States v. Klein. It is frequently used in cases of tax violations, but what it means is that someone with a fraudulent intent did something to obstruct or impede the official functioning of government. And so, in this instance, it would be something like, Trump and others conspired to defraud the American people and interfere with the proper transfer of Presidential power. And it could be as simple as getting Mike Pence to refuse to certify the vote when he had a duty to do so. Sometimes people think about the big picture, that you have to tie Trump to the physical attack on the Capitol. And that could do it, because that was one way that the certification was obstructed. But it could also simply be his efforts to pressure Mike Pence to refuse to certify the vote. And that would be an obstruction of an official proceeding.

Let’s face one important item, Trump did not do this alone. He had to have had help. And leading to and after January 6, what else took place?. What things could or did Add Fuel in the News that could have helped incite January 6 and the participants? Maybe a Lawsuit here or there? And they did Happen and Paxton was leading the Charge?

A disciplinary committee for the State Bar of Texas on Wednesday filed a professional misconduct lawsuit against Attorney General Ken Paxton for his attempt to overturn the results of the 2020 presidential elections in four battleground states won by President Joe Biden.

The filing in Collin County by the Commission for Lawyer Discipline, a standing committee of the state bar, is an extraordinary move by the body that regulates law licenses in the state against the sitting attorney general. It stems from complaints against Paxton for a lawsuit that the U.S. Supreme Court threw out, saying Texas lacked standing to sue and that Paxton’s political opponents called “frivolous.”

So, there is the January 6 Committee Investigation and now, it looks like Paxton is considered to have Attempted to Overturn the 2020 Presidential Election.

So, that Makes One who Attempted to Overturn the 2020 Presidential Election, but who else participated as well? Even before the January 6 Attempted Overturn?

After the 2020 United States presidential election, the campaign for incumbent President Donald Trump and others filed and lost at least 63 lawsuits[1] contesting election processes, vote counting, and the vote certification process in multiple states, including ArizonaGeorgiaMichiganNevadaPennsylvania, and Wisconsin.[2] Among the judges who dismissed the lawsuits were some appointed by Trump himself.[3]

Nearly all the suits were dismissed or dropped due to lack of evidence.[4] Judges, lawyers, and other observers described the suits as “frivolous[5] and “without merit”.[6][7] In one instance, the Trump campaign and other groups seeking his reelection collectively lost multiple cases in six states on a single day.[8] Only one ruling was initially in Trump’s favor: the timing within which first-time Pennsylvania voters must provide proper identification if they wanted to “cure” their ballots. This ruling affected very few votes,[9] and it was later overturned by the Pennsylvania Supreme Court.[10]

Trump, his attorneys, and his supporters falsely[11] asserted widespread election fraud in public statements, but few such assertions were made in court.[12] Every state except Wisconsin[13] met the December 8 statutory “safe harbor” deadline to resolve disputes and certify voting results. The Trump legal team had said it would not consider this election certification deadline as the expiration date for its litigation of the election results.[14][15][16] Three days after it was filed by Texas attorney general Ken Paxton, the U.S. Supreme Court on December 11 declined to hear a case supported by Trump and his Republican allies asking for electoral votes in four states to be rejected.[17]

One suit, Michigan Welfare Rights Org. et al. v. Donald J. Trump et al., was brought by black voter groups in Michigan against Trump and his 2020 presidential campaign.[18][19][20] Dominion Voting Systems brought defamation lawsuits against former Trump campaign lawyers Sidney Powell and Rudy Giuliani, each for $1.3 billion.[21][22] Smartmatic brought a defamation lawsuit against Fox Corporation and its anchors Lou DobbsMaria Bartiromo, and Jeanine Pirro as well as Giuliani and Powell for $2.7 billion.[23]

Loyola Law School professor Justin Levitt said “[t]here’s literally nothing that I’ve seen yet with the meaningful potential to affect the final result”.[42] Ohio State University election law professor Ned Foley noted “[y]ou have to have a legal claim, and you have to have evidence to back it up. And that’s just not there.”[26] University of Kentucky law professor Joshua Douglas said the lawsuits “all seem to have no merit whatsoever”.[43] Bradley P. Moss, an attorney specializing in national security, wrote that the suits “continue to defy reason and logic, and are purely theater … It’s all a farce”.[44] University of California, Irvine election law professor Rick Hasen said there is “no evidence of fraud so far that could conceivably affect the election results”.[25] Barry Richard, who helped to oversee the Republican-led Florida recount effort during the 2000 election, called the lawsuits “entirely without merit” and said they “will not be successful”;[45] Gerry McDonough, an attorney who worked for the Gore campaign, said Trump “has no chance of overturning the result—it’s just impossible”.[46] The Cybersecurity and Infrastructure Security Agency issued a statement calling the 2020 election “the most secure in American history” and noting “[t]here is no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised”.[31]

Jones Day, one of many law firms working for the Trump campaign and one that specifically handled Pennsylvania Democratic Party v. Boockvar,[47] faced internal criticism for its “shortsighted” efforts on litigation that “erode[s] public confidence in the election results”.[48][49]

The Trump campaign filed the most post-election lawsuits related to the 2020 United States presidential election in the swing states of Arizona, Georgia, Michigan, Nevada, Pennsylvania, and Wisconsin. It was a strategic decision to file lawsuits in these states that were too close to call during the night of election day and remained uncalled for a few days.

Group Seeks Disbarment of Ted Cruz Over Efforts to Overturn 2020 Election

A group trying to hold lawyers accountable for their efforts to keep Donald Trump in power after his election loss filed a complaint against the Republican senator with the Texas bar association.

“Mr. Cruz played a leading role in the effort to overturn the 2020 elections. And while the same can be said about several other elected officials, Mr. Cruz’s involvement was manifestly different,” the complaint said, asserting that Mr. Cruz moved beyond simply working within the confines of Congress.

“He chose to take on the role of lawyer and agreed to represent Mr. Trump and Pennsylvania Republicans in litigation before the U.S. Supreme Court,” the complaint said, citing his role in two cases, neither of which succeeded. “In doing so, Mr. Cruz moved beyond his position as a United States senator and sought to use more than his Twitter account and media appearances to support Mr. Trump’s anti-democratic mission.”

The court filing describes the direct role of Trump himself in developing strategy, detailing “two hand-written notes from former President Trump about information that he thought might be useful for the anticipated litigation.”

John Eastman, the attorney who architected Donald Trump’s last-ditch legal strategy to overturn the 2020 election, revealed Friday that he routinely communicated with Trump either directly or via “six conduits” during the chaotic weeks that preceded the Jan. 6 attack on the Capitol.

In a late-night court filing urging a federal judge to maintain the confidentiality of his work for Trump, Eastman provided the clearest insight yet into the blizzard of communications between Trump, his top aides, his campaign lawyers and the army of outside attorneys who were working to help reverse the outcome in a handful of states won by Joe Biden.
